you misread the RFC.
"Replies should always be sent from the port to which they were
directed. Except in extraordinary circumstances, this will be the well
known port assigned for DNS queries [RFC1700]."
just because replies to queries will always originate from port 53 (except
in extraordinary circumstances), does not mean that the original query
should originate from port 53.
