In software licenses, the intellectual property owner has stated a position
that is open to interpretation.
In patents, no knowledge of the patent is not a defense but it does
usually mitigate financial penalties. Your best bet is to ignore
patent claims that are obvious, may have prior art, or don't come
at the bottom of a lawsuit.
