An MX host must accept mail only for valid (known to exist) recipients
in the domains that it is responsible for, otherwise it becomes a
backscatterer.

If a spammer uses an ISP's outbound relay, then the mail is coming
though an account with that ISP, and they can either terminate the
compromised accpount or otherwise take the customer off the network.
